Terms of Service

Welcome to VibeGallery. By accessing or using vibegallery.ai (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

2. Account Registration

  • You may sign up using Google OAuth.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information and keep your profile up to date.
  • One person may not maintain more than one account.

3. User Content

3.1 Ownership

You retain ownership of the content you upload to the Service, subject to the rights granted to AI tool providers under their respective terms of service. You are responsible for ensuring you have the right to share any content you upload.

3.2 License to VibeGallery

By uploading content, you grant VibeGallery a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content in connection with operating the Service. This license ends when you delete your content, except for copies that may remain in backups or caches.

3.3 Content Guidelines

You agree not to upload content that:

  • Infringes on the intellectual property rights of others.
  • Contains illegal, harmful, threatening, abusive, harassing, defamatory, or obscene material.
  • Contains malware, viruses, or any harmful code.
  • Impersonates another person or entity.
  • Violates the terms of service of the AI tools used to generate the content.
  • Contains personal information of others without their consent.

4. AI-Generated Content

VibeGallery is a platform for sharing AI-generated content. You acknowledge that:

  • The ownership and copyright status of AI-generated content may vary by jurisdiction and by the AI tool’s terms of service.
  • You are responsible for complying with the terms of service of any AI tool you use.
  • VibeGallery does not claim ownership over AI-generated content uploaded by users.
  • You must accurately identify the AI tools used to create your content.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Interfere with or disrupt the Service or servers.
  • Use automated tools to scrape, crawl, or download content in bulk without permission.
  • Upload files exceeding the maximum allowed size (1.1 GB).
  • Circumvent any content moderation or security measures.
  • Use the Service to spam, phish, or distribute unsolicited messages.

6. Intellectual Property

The Service itself, including its design, logo, and underlying code, is the property of VibeGallery and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Translation Feature

The Service provides automated translation of content using AI language models. These translations are provided “as is” and may not be perfectly accurate. VibeGallery is not responsible for errors in translated content.

8. Termination

  • You may delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • We may retain certain data as required by law or for legitimate business purposes.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEGALLERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless VibeGallery and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
